Participant loans: prepare and maintain

7 min readRoth Academy field notes

A participant loan is a loan to a participant under the plan. It is different from the plan making an investment loan to an unrelated borrower.

01

Check the actual plan

Confirm whether participant loans are permitted and what terms apply. The amount available is a calculation based on the applicable rules and facts, not simply the account balance.

02

Formalize the arrangement

Complete the required documents and establish a repayment schedule before treating a transfer as an authorized loan. Existing loans may affect the analysis.

03

Track repayments

Keep the schedule, evidence of payments, and records of changes. If a payment is missed or circumstances change, request help promptly rather than waiting for year end.
